Form 390

Form 390: the annual summary of VAT

Nothing is paid: it is informative. Its only job is to reconcile. If the 390 does not match the sum of your four 303s, the letter arrives on its own.

What form 390 is

Form 390 gathers every transaction of the year for VAT purposes: output VAT, input VAT, the prorrata if there is one, and the result of the four settlements. Nothing is paid over with it.

Its value to the Tax Agency is as a control: the amounts have to reconcile with the four 303s. When they do not, either there is an error in one quarter or something was not declared at the time.

Who has to file it

Anyone who files the 303, with exceptions worth knowing about because they save you a formality:

  • Anyone keeping their books through the SII is exempt: they already send that information daily.
  • Also those taxed only under the simplified regime or who exclusively carry out the letting of urban property with quarterly settlement, in exchange for filling in the specific section of the last period's 303.
Deadlines

When the 390 is filed

With the weekend shifts already applied: when the last day falls on a Saturday, a Sunday or a public holiday, the deadline ends on the next working day.

PeriodDeadlineNote
Full tax year1 → 30 JanuaryIt is filed together with the fourth-quarter 303

January is the busiest month of the tax year: the fourth-quarter 303 and 130 land together with the 390, the 111, the 180, the 182 and the 190. Arriving with the books up to date is not a virtue, it is a necessity.

Watch out for this

The mistakes that come up most on the 390

There is only one way for the 390 to go wrong, but it is the decisive one.

It not reconciling with the 303s

That is literally what it is for. If the sum of the four quarters does not match the summary, the warning goes off and the formal query arrives.

Filing it when you are exempt

Anyone on the SII does not have to file it. There is no harm in doing so, but it is time lost in the month with the least time to spare.

Forgetting the prorrata adjustment

The final prorrata is adjusted in the fourth quarter, and that adjustment has to show up here too. Otherwise the summary and the settlement say different things.

Where every number on the 390 comes from

Nothing has to be typed in again: the form is worked out from the invoices and the expenses you have already entered during the period.

  • It is generated from the same invoices and expenses that fed the four 303s.
  • It reconciles by construction: there are not two different sources of data.
  • The fourth-quarter prorrata adjustment is carried through.
  • And in January it warns you about everything falling due that month, not just this one.

And you can open any box

Every amount on the form can be expanded to see exactly which invoices and which expenses make it up. That is what turns a figure into something you can defend if you are asked.

Questions about form 390

Those who keep their record books through the SII, and those taxed only under the simplified regime or who exclusively let urban property with quarterly settlement, filling in the specific section of the last period's 303 instead.
No. It is an informative return: the payment was made on each of the four 303s.
Find the quarter that is wrong and correct it before filing. If the error has already been filed, you correct it with a supplementary return or a request for correction, depending on whose favour it was in.

This page is for information and is reviewed whenever the legislation or the calendar changes. It does not replace your accountant: for your own case, ask someone who knows your numbers.

So the 390 stops taking an afternoon

If the invoices and the expenses are in, the form is already done.
